1. Terms of Use & Corporate Custodianship

Please read these Terms of Use carefully before using the Umoja Pharmacy website or mobile applications. By accessing or transacting on this platform, you agree to be bound by these terms.

2. Eligibility & Account Responsibilities

To access order fulfillment and specialized pharmacy services, users must create a registered account. By registering, you confirm that:

• You are at least 18 years of age and legally competent to enter into a binding contract under Tanzanian law.
• You will provide accurate, truthful, current, and complete personal and contact information.
• You will maintain the security of your account credentials and immediately notify us of any suspected unauthorized access.

3. E-Commerce Platform & Sale Terms

Umoja Pharmacy operates B2C retail e-pharmacy services and B2B wholesale distribution of pharmaceutical products in Tanzania.

• Invitation to Offer: Product listings on the platform constitute an invitation to offer for sale. Placed orders represent an offer by the buyer subject to stock confirmation and prescription validation.
• Pricing & Taxes: All product prices displayed on the platform are in Tanzanian Shillings (TZS) and include applicable legal statutory taxes unless explicitly stated otherwise.
• Delivery Agents: Medicines and wellness orders are delivered via authorized courier partners acting with your consent.

4. Prescription Drugs Dispensing Policy

In full compliance with Tanzania Medicines and Medical Devices Authority (TMDA) and Pharmacy Council regulations:

• Valid Prescription Required: Orders containing prescription-only medicines (POM) will only be processed after a scanned copy of a valid medical prescription from a registered doctor is uploaded and verified.
• Original Verification: Original prescriptions must be presented to our licensed delivery agent upon medication receipt.
• Generic Substitution: Substitution of prescribed medication with equivalent generic salts is only conducted when explicitly authorized by the prescribing medical doctor.

5. Intellectual Property & Advertisements

All logos, brands, software code, custom graphics, and website design assets are the exclusive intellectual property of Umoja Pharmaceuticals Ltd and Melian Software Company Ltd.

Third-party advertisements displayed on the platform are subject to strict health advertising guidelines, preventing deceptive health claims or misleading promotions.

6. Governing Law & Jurisdiction

These Terms of Use shall be governed by, interpreted, and construed in accordance with the laws of the United Republic of Tanzania, including the Tanzania Contract Act and the Information Technology Act.

Any legal action or proceeding arising under these terms shall be brought exclusively in the courts located in Dar es Salaam, Tanzania.
